Key rules for employers
All workers are entitled to 5.6 weeks (28 days for full-time) paid holiday per year. You can offer more but never less.
There are 8 bank holidays in England & Wales. These can count toward the 28-day minimum or be given on top — your choice as employer.
Entitlement is pro-rated for employees starting or leaving part-way through the leave year based on weeks worked.
Holiday must be paid at the worker's normal rate of pay, including regular overtime and commission. The first 4 weeks must reflect full "normal remuneration" — confirmed for 2025/26.
Workers can carry over up to 4 weeks if unable to take holiday due to sickness. From April 2025, Neonatal Care Leave also accrues holiday — both parents can take this as a day-one right.
The 2026/27 leave year has 10 bank holidays — 2 more than usual. If your contracts say "20 days plus bank holidays", you may be obliged to give 30 days total. Check your contract wording now.
Irregular and part-year workers accrue at 12.07% of hours worked per pay period. From April 2025, rolled-up holiday pay (adding 12.07% to each payment) is now fully legal as an alternative.
